Terms of use of Eye Learning (EL) website and course

EL is a business partnership carried on by Kelly Chard and Stephanie Goodwin. Reference to EL in these Terms refers to this business partnership.

You will need to use the EL website (Website) to access and undertake the Ophthalmic Assistant Online Training Course and Ophthalmic Receptionist Online Training Course (Courses).

By accessing and using the website and courses, you agree to these terms of use (Terms).

Modification of Terms

EL may modify or amend these Terms from time to time and by using and accessing the Website you agree to be bound by the modified or amended Terms. EL recommends that you regularly review the Terms to ensure that you are aware of any modifications or amendments.

Terms of use

To use and access the Website and courses you must:

  • be an individual person;
  • provide EL with your full legal name;
  • have internet access and a valid email address; and
  • provide EL with any other information which is requested to enable the sign-up process to enable you to commence and complete the Courses.

Your right to login to the Website is an individual right and may not be accessed by others.

You are responsible to maintain the security of your EL log-in name and password.

The Courses

The Ophthalmic Assistant Course is intended to provide students with a basic knowledge of some of the skills required to work as an ophthalmic assistant.

The Ophthalmic Receptionist Course is intended to provide students with a basic understanding of ophthalmology to assist in administrative duties.

You acknowledge that the Courses are not accredited by any external body or organisation.

Successful completion of the Courses by a student does not qualify the student to:

  • work independently in an ophthalmic or other clinic;
  • administer mydriatic or dilating eye drop medications or other Schedule 4 medications;
  • perform subjective refractions; or
  • interpret test results

Assessment of student competency

The Ophthalmic Assistant Course must be completed within 3 months of commencement/registration. The Ophthalmic Receptionist Course must be completed within 6 weeks of commencement.

Course extensions may be available at the discretion of EL. However, access beyond 6 months of commencement will incur an additional cost of $200AUD (exclusive of GST) per student.

Successful completion of the Courses requires students to complete each and every subject area within the Courses, and complete and pass an online examination with a pass mark of at least 75%.

The examination must be completed in a single sitting and within the allocated time.

A Certificate of Completion will be issued to students who successfully complete and pass the Courses.

Fees and refunds

Fees for the Courses:

  • must be paid in full by PayPal or direct deposit prior to the commencement of the Course;
  • are inclusive of GST; and
  • are non-refundable.

Prepaid courses that have not commenced within 12 months of payment may expire at ELs discretion.

In the event EL ceases to operate, prepaid courses will not be refunded.

No unlawful or prohibited use

You agree that you will not use the Website or Courses:

  • for any purpose that is unlawful or prohibited by these Terms; or
  • in any manner which could damage EL or EL’s reputation.

Any breach of these Terms by you may result in EL terminating or restricting access to your account.

Intellectual Property Rights

No material on the Website (including course content, examination papers, certificates and logos) may be duplicated, reproduced, modified, distributed, sold, published, broadcast or otherwise retransmitted without the prior written consent of EL. All information, text, material, graphics, software, intellectual property rights and other information on the Website is the property of EL and may not be used without EL’s prior written permission.

Liability disclaimer

EL makes every effort to ensure that the information provided on the Website is accurate. However, EL cannot guarantee this and accepts no liability for any information on the Website which is incorrect. EL will not be liable for any indirect, incidental, damages (including consequential damages) or loss of profit incurred by any person as a result of accessing and using the Website.

EL may provide hypertext links to external third party sites on the website and EL takes no responsibility or liability for the material on those third party sites.

Governing law

These Terms are governed by the laws of New South Wales and the federal laws of the Commonwealth of Australia, notwithstanding your domicile, residency or physical location. You agree to the exclusive jurisdiction of the courts of New South Wales.
